Guidelines on Standard Procedures for Early Termination of Contracts of Foreign Domestic Helpers

Stage 1: Formal notification to the Immigration Department

- Statutory termination conditions
- Employer proactively terminates the contract
▸ 1 month’s written notice or payment of “wages in lieu of notice” (full monthly salary) is required
▸ According to Section 15 of the Employment Ordinance, the employment contract of a foreign domestic worker cannot be terminated due to pregnancy/work injury/complaint discrimination - Foreign domestic helper voluntarily resigned
▸ Make sure the resignation letter contains a handwritten signature and date. A notarized copy is recommended.

If the contract with a foreign domestic helper is terminated prematurely, how long can the domestic helper continue to stay in Hong Kong?
With the premature termination of the foreign domestic helper contract, the foreign domestic helper may only stay in Hong Kong until two weeks after the termination of the contract or until the expiry of the permitted period of stay, whichever is the earlier.
Do I have to pay for the domestic helper's baggage fee on their flight ticket?
According to the current regulations, there is no explicit requirement to pay for the luggage fees of the domestic helper's flight tickets.
How much annual leave should be given to a domestic worker who is fired early?
According to the Employment Ordinance, foreign domestic workers can enjoy annual leave in proportion to the "continuity contract".
