Purchase a unit (Green Form Eligibility)

Eligibility for Purchasing HOS Secondary Market Flats (Green Form Eligibility)

  • The following persons can apply to purchase a flat in the HOS Secondary Market:

     1. Residents of public rental housing (PRH) under the Housing Authority (“Conditional Tenancy” residents or residents renting transitional rental housing units of the Housing Authority on a monthly permit basis are not eligible to apply); 2. Residents of Type A rental estates/elderly housing units (“rental estates”) under the Hong Kong Housing Society (“HS”) (Residents of Type B rental estates or residents renting transitional rental housing units of the Housing Society on a monthly permit basis are not eligible to apply); 3. Authorized residents of interim housing under the Housing Authority; 4. Persons holding a valid “Green Form Eligibility Certificate – Only applicable to the Home Ownership Scheme Secondary Market Scheme” issued by the Housing Authority or the Urban Renewal Authority (“URA”); and 5. Beneficiaries of the Housing Authority’s “Elderly Rent Subsidy Scheme”.
  • Singles and families can apply;
  • Applicants must be 18 years of age or older;
  • For those applying as a family group, the applicant and family members must be relatives;
  • If the applicant and/or family members named in the application form are married, their spouse must also be named in the same application form (except for those who are legally divorced, whose spouse does not have the right to land in Hong Kong or is deceased). If the spouse does not have the right to land in Hong Kong, he/she must complete the relevant declaration and return it together with the marriage certificate and a copy of the spouse's local resident identity card; divorced persons must return it together with a copy of the Certificate of Absolute Decree (Divorce Case) granted by the court (e.g. Form 6 or Form 7B), otherwise their spouse must also be listed in the same application form. If the above requirements are not met, the Housing Authority has the right to cancel the relevant application.

The revised eligibility criteria for Green Form applicants to purchase subsidized sale flats will be implemented from July 31, 2023. Under the amendments, HA public rental housing tenants, Interim Housing Approved Residents and Housing Society rental estate residents who apply to purchase subsidised sale flats as Green Form applicants are not allowed to own residential properties in Hong Kong from 24 months before the date of application for the "Certificate of Eligibility to Purchase" until the date of signing the preliminary sale and purchase agreement for the purchase of the subsidised sale flat. In addition, HA’s periodic temporary residence permit holders will no longer be eligible to purchase subsidised sale flats as Green Form applicants. If the relevant certificate holders meet the relevant eligibility requirements, they can apply to purchase subsidized sale flats as White Form applicants.

Ineligible applicants:

1.Owners/borrowers and their spouses who have benefited from the following subsidized home ownership schemes (including those who were not the spouses of owners/borrowers when they benefited from the following subsidized home ownership schemes) are not eligible to apply again, even if the owner/borrower has sold the flat or repaid the loan - Home Ownership Scheme (HOS); Private Sector Participation Scheme; Green Form Subsidized Home Ownership Pilot Scheme/Green Form Subsidized Home Ownership Scheme (GSH); Middle-Income Family Housing Scheme (Meile Garden); Redevelopment Home Ownership Scheme; Buy or Rent Scheme; Home Ownership Scheme Secondary Market Scheme/Extension of Home Ownership Scheme Secondary Market to White Form Buyers ("Temporary Scheme- 2013 and 2015)/White Form Home Ownership Scheme Secondary Market Scheme (WSH2); Home Purchase Loan Scheme/Home Purchase Assistance Loan Scheme; Tenants Purchase Scheme (TPS); any subsidised housing schemes under the Housing Society (including Subsidised Sale Flats, Flat Sale Scheme, Flat Sale Scheme Secondary Market, Sandwich Class Housing Scheme and loan schemes, etc.); and any subsidised sale flat schemes under the Urban Renewal Authority.
2.A key member who has purchased a subsidized home ownership scheme flat under paragraph 1 above for less than 2 years from the date of signing of the deed of transfer (except a key member whose household registration has been deleted due to marriage or being allowed to enjoy housing benefits provided by the employer). Other family members are not subject to this restriction as long as they meet all the application requirements. A “key member” refers to another member other than the owner listed in the same application, so as to meet the application requirement of having a minimum of two “family applicants”.
3.Any member of any Civil Service Building Co-operative Society or similar housing scheme, or a property concessionaire under any local civil service housing scheme (other than a public housing tenant).

Persons who received compensation based on Home Ownership Scheme (HOS) prices from the Government for the demolition of Kowloon Walled City and chose to make their own accommodation arrangements, and their spouses (including persons who were not yet spouses of the compensees at the time of receiving the relevant compensation).
5.Persons who choose to receive ex-gratia allowance/ex-gratia payment/cash subsidy issued by the Housing Authority/Housing Society/Urban Renewal Authority/Lands Department due to house demolition and relocation but are not allocated any form of public housing or interim housing are not eligible to apply for the re-entry subsidy within two years from the date of receipt of such allowance.
6.Eligible households who have chosen to receive the "ex-gratia cash subsidy option only" due to the land resumption for the construction of the Hong Kong section of the Guangzhou-Shenzhen-Hong Kong Express Rail Link, the Liantang/Heung Yuen Wai Boundary Control Point project and its demolition are not eligible to apply within three years from the date of receiving the subsidy.

7.
Residents of Group B rental estates managed by the Housing Society.
8.Users of temporary residence permits in units rented out by housing associations (except for residents who have signed a one-year temporary residence permit because they do not meet the minimum resident requirement of the unit).
9.Holders/users of transitional rental housing units rented by the Housing Authority or the Housing Society on a monthly tenancy permit/temporary residence permit basis.
10.Residents of Housing Authority public housing estates under a "conditional tenancy agreement" or holders of a temporary residence permit.
11.After examining the application form, the Housing Authority has the right to reject the application without refunding the application fee.
